Consider recommending adoption of an ordinance of the City Council of the City of Denton, Texas authorizing the City Manager or his designee to execute an agreement with Texas Municipal Power Agency (TMPA) regarding reimbursement for transmission line grading work to be performed by Denton Municipal Electric in the easement of a 138kV line located on the property of Medical City Healthcare.

BACKGROUND
Texas Municipal Power Agency (TMPA) owns rights to an easement located on property owned by Medical City Healthcare, formally known as Denton Regional Medical Center. In a recent study done by TMPA, it was discovered that Medical City Healthcare had performed construction and landscaping activities that violated National Electric Safety Code (NESC) minimum parameter standards by reducing the required clearance. Although the line is owned by TMPA, Denton Municipal Electric (DME) has a Transmission Operator, Maintenance, and Construction Services Agreement in place to perform all necessary operations for TMPA Denton area transmission system assets. Because the easement and line are located on property owned by Medical City Healthcare, Medical City Healthcare is responsible for the costs associated with bringing the line into compliance

DME and Medical City Healthcare officials met and discussed the transmission line grading matter. Both parties understand and agree Medical City Healthcare is responsible for the work that will be performed by DME and will reimburse DME. If an agreement with Medical City Healthcare is not finalized, TMPA will be responsible for paying the costs of the grading work.

RECOMMENDATION
Staff requests recommending approval of the agreement for reimbursement as presented
