BACKGROUND
84 Lumber is in the process of constructing a railroad spur and additional buildings on their property at 3147 Jim Christal Road. In staff's review of the proposed railroad spur improvements in relation to impact on existing utilities, it was determined that it would be necessary to install a 12-inch waterline and decommission the existing 6-inch waterline in that location. The existing 6-inch waterline is undersized and does not meet the protective steel casing sleeve requirements to support rail traffic.

84 Lumber has agreed to construct the 12-inch water line across the spur area and railroad property. In order for the 12-inch waterline to be constructed, a crossing agreement with Kansas City Southern Rail Company is necessary. 84 Lumber has paid all application fees and has provided all insurance requirements required by Kansas City Southern Railway Company. Upon completion and acceptance of the water improvements by the City, ownership of those improvements will transfer to the City of Denton.

OPTIONS
1. Recommend approval.
2. Do not recommend approval.

RECOMMENDATION
Staff recommends approval of the Ordinance.
