Staff recommends approval.

BACKGROUND
Oktoberfest on Walnut is an outdoor concert that will be held on City Walnut Street, between Locust and Elm Streets on October 3, from 5 pm until midnight. Pete Kamp, festival organizer, submitted a request (Exhibit 1) to sell alcoholic beverages during the festival that will be provided by DI2-Denton I, LLC, dba Lone Star Attitude Burgers, WABL, LLC, dba Abbey Inn and Denton Sweetwater Grill.

The street will be closed for live music, the sale of alcohol and vendor booths. This is a free event and organizers expect approximately 1,000 people to attend.

The restaurants bordering Walnut Street will serve alcohol at the event: The Abbey Inn, Lone Star Attitude Burgers and Sweetwater Grill and Tavern.

RECOMMENDATION
Staff recommends approval of the resolution and agreement as submitted, which is consistent with agreements for other events serving alcoholic beverages.

PRIOR ACTION/REVIEW (Council, Boards, Commissions)
City Council allowed the sale and consumption of alcohol on Walnut Street for the Mardi Gras on Walnut Street event which was approved at the February 18, 2014 Council meeting.
